Mel Gibson phone

If you had this nagging feeling that there must be some law against recording conversations, you are right.

The audio tape recording of what appears to be Mel Gibson is already the focal point for the attorneys and law enforcement involved in the high-profile domestic-violence investigation and child-custody dispute between the filmmaker and ex-girlfriend Oksana Grigorieva. If it is Gibson in the recording, is it admissible in court?

According to reports, Grigorieva secretly recorded the conversation, which was banned from release by the judge overseeing the child-custody lawsuit but somehow leaked to Radar Online. In California, it is illegal to intentionally record a confidential communication without the consent of all parties to the communication.

Secretly recording a confidential communication -- defined by the California Penal Code as any communication carried on in circumstances reasonably indicating that one or more of the parties desires it to be confined to the parties to the communication -- is punishable by up to a $2,500 fine or imprisonment of up to a year, or both.

Gibson, as the party who was allegedly secretly recorded, may also have a civil right of action against Grigorieva for statutory damages of $5,000 or actual damages, plus payment of his attorneys' fees and costs.

Of course, the possible consequences of secretly recording a confidential communication do not stop there. The recording also may not be used as evidence in any court or administrative proceeding, which, at first blush, can be a great shield for Gibson in both the child-custody dispute and domestic violence investigation.

But there are exceptions. A party to a conversation may record the conversation if the communication is related to the commission of a crime against a person. In the tape, the man's voice is menacing, enraged, and filled with sexual slurs. He even threatens to hit the woman on the head with a baseball bat. Moreover, to the extent a domestic violence restraining order is in place, the "victim" may record a communication to prove that the restraining order was violated.

Reports have indicated that Gibson's attorneys have already filed a contempt motion with the court for what they believe is a violation by Grigorieva of the court's order to not leak the tape. Grigorieva denies leaking the tape. If the judge believes her, Gibson's attorneys may consider going after the party disclosing the tape to the public, because the California Penal Code also makes it a crime to disclose a telephone communication without the consent of the party to whom the communication was directed.

What about 4G in phones?

And here lies our problem with some of the current phones on the market by AT&T and T-Mobile, which have that overused 4G moniker added to their names. A quick look at the spec sheets of some of those devices shows that they only offer peak download speeds of 14.4 Mbit/s, and upload speeds of 5.76 Mbit/s. Examples for such phones on AT&T are the LG Thrill 4G, Motorola ATRIX 4G, HTC Inspire 4G, HP Veer 4G... while on T-Mobile, such handsets are the HTC Sensation 4G and myTouch 4G. So, even though these handsets do not meet the performance requirements outlined in the official HSPA+ standard, AT&T and T-Mobile have decided to call them “4G”, which is obviously misleading, to say the least.

Recently, we've begun to see phones with the radios that are capable enough to be called 4G, or at least when it comes to download. T-Mobile's myTouch 4G Slide, Samsung Exhibit 4G, Sidekick 4G and Galaxy S 4G are good examples of that. All of these handsets deliver theoretical peak download speeds of 21 Mbit/s, which can be safely considered true HSPA+ connectivity. Well, when it comes to the uplink, those handsets still max out at 5.76 Mbit/s, which is well below the possible 11.5 Mbit/s for HSPA+, so from that point of view, these devices are still semi-4G. But considering that download is more important than upload to most users, let's say that we can live with this.

We inquired T-Mobile, in order to see what their position is with regards to why they are calling those HSPA 14.4 Mbit/s phones “4G”. T-Mobile's explanation was that they think of those devices as 4G, because even if they do not comply to the requirements for peak HSPA+ speeds, they still offer improved latency and better performance (obviously, compared to 3G devices). So, there you have it, the carrier decides that it can have 4G devices, without them being fully compliant to the standards.

We also inquired AT&T, and they first tried to explain that their devices take full advantage of the HSPA+ network in areas where it is combined with "enhanced backhaul". However, this simply means that HSPA+ capable handsets are able to take full advantage of the network in those areas. But when we pointed out that they actually lack such handsets, as all of the "4G" phones in their lineup, except for the Infuse 4G, currently max out at 14.4 Mbit/s (normal, 3G HSPA), they agreed. So it looks like they are just adding that "4G" part in their phones' names for the sake of attraction.

It turns out your “4G” phone may actually not be quite 4G, in case you are using one of those models that do not comply to the characteristics outlined in 3GPP's Release 7 and up. The best way to check if the model you're currently eying or having is truly HSPA+ 4G capable, is to take a look at its specs page on our site. In the General Info section (the first one), under Data, it should say “HSPA+ (4G)”, with maximum HSDPA speed of at least 21 Mbit/s (to be precise, it can have 17.6 Mbit/s download and still be 4G, as this is an additional 4G HSPA+ category, which, however, has not been used in phones).

It is clear that the way AT&T and T-Mobile are acting with regards to their “4G” phones isn't really upright, since a lot of users could be misled to believe they are actually using a device that is compliant to the official standards. 4G in networks

In today's state of the market, one of the most touted and sought-after features in phones is 4G. Indeed, the ability to take advantage of much faster data speeds, compared to what we had just a year ago, is nothing short of awesome, as we're increasingly using our phones to connect to the internet, for most various reasons.

But are we really getting 4G with all of those 4G-branded devices out there, and could it be so that some carriers are simply using the term in order to make their devices look more attractive, without delivering the true 4G connectivity that is expected from such a device?


4G in networks

Most of you probably remember that the initial rulings by the ITU (International Telecommunication Union) indicated that none of the current carrier networks were 4G. Initially, it was only the next-generation LTE-Advanced and WiMAX 2 technologies that were considered 4G, due to their ability to offer download throughputs of about 100 Mbit/s. However, once the carriers started reasoning that their current services offer significant improvements over standard 3G that shouldn't be overlooked, the ITU eventually decided the all three current technologies – LTE, WiMAX and HSPA+, should be considered fourth-generation.

So far, so good. However, it seems that even with the ITU's now more relaxed understandings of what a 4G network is, there are still some phones on the market, which are branded as “4G”, but actually do not deliver those promised speeds. How come?

Before HSPA+, there was HSPA, an enhanced version of original 3G networks. HSPA (standing for High-Speed Packet Access) was defined in 3GPP's (this is the institution where all these standards originate from) Release 5 and 6, where it is clearly stated that HSPA allows for theoretical peak downlink speeds of 14.4 Mbit/s, and theoretical peak uplink speeds of 5.76 Mbit/s. Again, HSPA is still considered 3G (some like to call it 3.5G).

The HSPA+ standard is first specified in 3GPP Release 7, where it is defined to offer peak speeds of 21 Mbit/s on the downlink, and 11.5 Mbit/s on the uplink. This is the technology that is considered 4G by the ITU.

LG Announces Android Smartphone


LG has announced its latest addition to the Optimus line with the Optimus Q Android smartphone. The Optimus Q features a much larger and brighter 4.0 inch IPS capacitive touch display which LG rates at 700 nits of brightness, making it one of the brightest displays in the Optimus line next to the current Optimus Black along with a thinner bodyshell than is typically found on phones with sliding hardware keyboards.
Specifications for the Optimus Q consist of Android Gingerbread,  5.0 megapixel main camera, VGA camera on the front for video calling underpinned by a 1.2 GHz dual-core Tegra 2 CPU along with Wi-Fi, Bluetooth and a microSD slot. Sprint will be releasing its variant of the Q next month according to previously leaked roadmaps.

The BlackBerry Torch is among the best text messaging phones. It boasts a 3.2" high resolution touchscreen, optical trackpad, and slide down QWERTY keyboard. It operates off of AT&T's 3G network and offers 4GB of internal memory and a microSD card slot for expansion.It runs with the BlackBerry 6 OS and offers wireless-N networking and connectivty with over 20,000 AT&T Wi-Fi hotspots.

This is especially useful when planning group meetings.

Android phone - Motorola Photon 4G


The Motorola Photon 4G certainly puts the "smart" in smartphone. This device has it all: a dual-core processor, the latest version of Android, a qHD 4.3-inch screen, world phone capabilities, enterprise-level security features, HD video recording, and more. In short, there's not a lot the Motorola Photon 4G can't do, and it rightfully earns a spot among today's best phones.
Slick Looks

The Motorola Photon 4G doesn't quite look like every other Android phone out there on the market -- and that's a good thing. While this phone sports the big touchscreen and slab-style like so many of today's phones, it features a slightly different shape: Motorola has lopped off the four corners of the device, giving the phone something of an intimidating look.

But the Photon 4G also is pretty bulky: it makes an iPhone 4 look downright diminutive. The Photon 4G measures 5 inches tall by 2.6 inches wide by .5 inches thick, and weighs in at a hefty 5.6 ounces. The design looks and feels solid.

Also attractive is the big, bright touchscreen. At 4.3 inches diagonally, the screen offers plenty of real estate, and its 960-by-540 resolution makes images and text look sharp and clear. The touchscreen was very responsive, and it features a Gorilla Glass display that is designed to be scratch resistant and glare reducing, so you can use the phone in very bright sunlight
Making Calls

I made several test calls over Sprint's network, and found that the Motorola Photon 4G delivered good call quality. For the most part, voices were loud and clear, but I noticed a slight bit of distortion during some calls. And, much like the HTC EVO 3D, the Photon 4G felt a bit bulky to hold during some calls.
4G Support

The Motorola Photon 4G is the latest addition to Sprint's lineup of 4G-capable phones. The device can automatically connect to available 4G networks, which deliver super-speedy data service. You can turn off the 4G connection to conserve battery life, too. To learn more about 4G service, see 4G Wireless: Everything You Need to Know.

Like Sprint's other 4G phones, the Photon 4G retains support for 3G and Wi-Fi wireless networks; I tested the phone over all three connections and found it consistently delivered high-speed browsing.

Like the HTC EVO 3D, the Photon 4G supports Sprint's mobile hotspot service, so you can use it to create a hotspot to which you can connect up to 8 Wi-Fi enabled devices. To use this feature, you will need to subscribe to Sprint's $29.99-per-month mobile hotspot service, though.
Software

The Photon 4G runs Android 2.3, the latest version of Google's mobile OS. Android has grown more refined with each release, and version 2.3 is certainly impressive. It's more polished and refined than earlier versions, which were a bit geeky. Read my full review of the Android OS for more information.

On top of the Android OS, the Photon 4G features Motorola's MotoBlur interface, which is also used on phones like the Motorola Cliq and the Motorola Atrix. Luckily, the version found here is less intrusive. For starters, unlike past versions of Motoblur, this one doesn't require that you sign up for a Motoblur account to use the phone. It also places its main features -- widgets that deliver status updates and more from your favorite social networks -- on a secondary home screen, so you're not overwhelmed with them when you turn on your phone.

In addition to Motoblur, the Photon 4G also features Sprint ID, which is a way to add a theme to your Android phone. You can select from options such as Entertainment, Green, or Sports, which add widgets, shortcuts, and wallpaper to your phone. You can choose not to install a Sprint ID if you don't want one.
Camera

The Photon 4G features both forward and rear-facing cameras. On the front, you get a VGA camera for video calls, though the phone doesn't come with a video chat app installed. That means you'll have to install your own to make video calls. On the rear of the phone, you get an 8-megapixel camera that captures video good images. My test photos looked very sharp and colorful. I did have trouble capturing moving subjects, though.

The Photon 4G can record HD video in 720p HD and my test clips looked pretty good. Colors were vivid and the audio was good, but I did notice some occasional blockiness.
Multimedia and More

The Motorola Photon 4G comes packed with multimedia features. It offers a very good built-in music player, and includes software for transferring your digital audio files to the phone. You also get access to Amazon's MP3 store, FM radio, and a YouTube app.

Movie aficionados will appreciate the big screen, and its ability to play back HD video in 1080p. The Photon 4G also includes an HDMI out port so you can connect the phone to a flat-screen HDTV. In addition, it has DLNA support, which allows you to stream content to compatible DLNA devices, such as set-top boxes.
Down to Business

The Photon 4G isn't all fun and games, though. The phone also includes a number of features that business-savvy users will appreciate. It supports Microsoft Exchange ActiveSync, which will allow you to sync your business e-mail and calendar. The phone also features improved data encryption for security and a remote wipe feature. The Photon 4G is similar to Motorola's Atrix, which can be used with a laptop-like accessory. With the Photon 4G, the accessory is called an HD Station, and it costs $129. It has USB ports and an HDMI out port, so you can connect the phone to a display, mouse, and keyboard. Then you can run apps like a desktop version of Firefox, using the phone almost like a mini computer.
Price and Availability

Sprint is offering the Photon 4G for $199.99 when you sign a two-year service agreement. You will have to commit to one of the carrier's data plans, but Sprint is, at least, one of the few carriers still offering unlimited data. On top of that, though, you will need to add a $10-per-month Premium Data add-on for the 4G service -- and that add-on plan is required whether you live in an area with 4G coverage or not.
Bottom Line

The Motorola Photon 4G is a full-featured smartphone that will please business users and entertainment addicts alike. It packs as much power as a PC used to, just a few years ago, so this is a phone that can certainly handle most day-to-day tasks, and more.

There will be an iPhone 5

Apple hasn't announced that there will be an iPhone 5 yet, let alone released any details on the refresh of its top-selling smartphone , but a majority of current iPhone users are ready to trade up for the new model, sight unseen.
That's one of the findings in a survey from ChangeWave of 2,200 mobile -phone users conducted Aug. 2-10. The poll suggests that despite all the competition, two-thirds of iPhone 3GS or iPhone 4 users want a new iPhone, while 31 percent of all respondents are very or somewhat likely to get one, up from 25 percent in the same survey before the iPhone 4 was launched last summer.
Sprint Customers Ready
And with Sprint Nextel believed to be on the verge of becoming the third carrier to stock the iPhone, 54 percent of Sprint subscribers answered that they're significantly or somewhat more likely to buy an iPhone, as were 53 percent of T-Mobile customers. A merger with AT&T , the first iPhone carrier, would make that possible.
The survey follows on the heels of a July online PriceGrabber poll of 2,852 consumers that found 35 percent plan to grab a new iPhone, with 52 percent of them indicating they'll buy it within the first year of release; 30 percent plan to get one by the end of 2011; and 14 percent hope to buy it within the first month. Seven percent will get online to buy it within the first week. That survey was conducted July 1-11.
Apple has released a new iPhone every summer since 2007, usually in June.
The latest data "shows that for most, the iPhone remains the most usable of all the devices," said Gartner Research analyst Ken Dulaney. "The users are extremely happy with the balance of functionality and simplicity and until Apple disappoints them, they remain committed."
In a second survey of 2,297 consumers, Sept. 6-12, ChangeWave found that the resignation of Apple CEO Steve Jobs stands to have almost no effect on the demand for Apple products.
No Jobs Loss
Only 4 percent said Jobs' resignation makes them less likely to buy Apple products in the future, while 89 percent said the change had no effect.
